Harper Obtains Summary Judgment in Underinsured Stacking Case
Harper successfully argued a Motion for Summary Judgment in an Underinsured Motorist Coverage stacking case. In the case, the Plaintiff was involved in an accident with a motorist with liability limits of $25,000. The Plaintiff possessed a policy of insurance which provided underinsured motorist coverage for three vehicles. The Plaintiff argued they were entitled to stack the coverage available on the three vehicles in spite of policy language prohibiting stacking. The Court agreed that there was no right to stack the underinsured motorist coverage.
