Stephen Fields obtains defense verdict for nursing home client
Steve Fields obtained a defense verdict for a nursing home client in a jury trial in Scott County, MO. Plaintiff was visiting his mother when he claimed the nursing home staff asked him to assist in lifting his mother off the floor. Plaintiff claimed to have injured his back resulting in a lumbar fusion surgery. Plaintiff claimed the staff failed to follow policy and violated the standard of care by asking the Plaintiff to assist in the care. The nursing home staff disputed the incident occurred and never asked Plaintiff to assist. The defense also argued Plaintiff’s pre-existing back injury ultimately led to the lumbar fusion surgery. The jury returned a defense verdict in favor of the nursing home.
